Program Description: This program provides a general overview of healthcare fraud & abuse laws that affect providers including False Claims Act, Stark & Anti-Kickback Statutes. Statistics, investigations, problematic conduct (including blatant overutilization) and sanctions are discussed. Administrators will gain a practical understanding of the Texas Medicaid Fraud Prevention Act—enforced by CMF Division of Texas Attorney General Office, criminal statutes, whistleblower/qui tam actions, as well as tips on responding to governmental inquiries (e.g. Texas Medicaid Fraud Control Unit). Presentation Date: 11.17.2015

Program Objectives: Upon completion of this program, the viewer will be able to:

  • Describe healthcare fraud concepts.
  • Describe penalties associated with healthcare fraud.
  • Identify best practices to prevent fraud and abuse in the home health setting.

About the Presenter:
Troy Brooks
is a former Assistant General Counsel for the Texas Department of Human Services, and has worked extensively with the Home and Community Support Services Agencies Program. Troy now represents home health agencies across Texas in Medicare and Medicaid disputes with government agencies and their contractors. He also represents home health agencies in negotiating and responding to government fraud investigations. Troy runs his own law firm, Brooks Acevedo Attorney at Law, here in Houston, Texas.
