Program Description: This provides a basic overview of the primary fraud and abuse laws that affect healthcare providers:

  • Stark Law
  • Anti-Kickback Statute
  • Civil Monetary Penalties

While providing a fundamental understanding of these laws to new administrators, the program also includes changes to these laws brought about by the Affordable Care Act. These laws affect everything from marketing to the delivery of care to governance in health care agencies. By discussing these laws in context of common scenarios, the program provides viewers with a practical understanding of how they work. Presentation Date: 11.18.2014

Program Objectives: Upon completion of this program, the viewer will be able to:

  • Recognize one law that addresses fraud and abuse in healthcare.
  • Describe one business arrangement that would violate the Stark law.
  • Identify one form of remuneration as defined in the Anti-Kickback Statute.
  • Evaluate one marketing arrangement that could be considered an illegal inducement.

About the Presenter:
Charlotte E. Patterson, RN, BSN, JD,
is a SVP & Chief Compliance Officer of AccentCare in Irving, TX. Ms. Patterson providing legal and compliance guidance regarding a wide range of matters, including Health Law, State and Federal regulations, HR and employment issues. Her past practice includes Chief Compliance Officer for a large Homecare and Hospice organization, Claims Counsel for an international insurance corporation and Medical Malpractice litigation. Ms. Patterson received her B.S. in Nursing at the University of Florida and her J. D. at the University of Texas.
