Summary: This 6-part program provides focus on DADS regulatory compliance for HCSSAs, including the new and revised DADS regulations enacted July 2012. This program provides, in its entirety, the TAHC&H-sponsored DADS Joint Training program as presented on Oct 18, 2012 in Dallas, including Questions from attendees and the valuable Answers from DADS staff.

Program Description: COMPLIANCE is more important than ever in light of the new rules recently published by the Texas Department of Aging and Disability Services [DADS]. This program assists in mitigating the risks of increased civil money penalties from the state.

The program includes a presentation on the survey process, how to recognize deficient practices, how your agency's Quality Assessment and Performance Improvement [QAPI] is factored into any decision to cite non-compliance, and the enforcement process including the Informal Review of Deficiencies [IRoD] and administrative penalties.

The program also includes a look at the most recent data on the top ten survey violations and include surveyor probes and interpretations, a detailed look at emergency preparedness, and a regulatory update on compliance with the new rules related to licensure changes in information, prohibition of solicitation, administrative and supervisory responsibilities and educational training for administrators.

All licensed HCSSAs must be aware of and comply with the topics in this 6-part program.

Program Objectives: Upon completion of this program, the viewer will be able to:

    Segment1
  • Describe DADS' Regulatory Services responsibility
  • Identify the 6 tasks in the survey process
  • Explain the importance of the Quality assessment and Performance Improvement Program and who is responsible for its implementation
    Segment 2
  • Locate the Code of Federal regulations and the Texas Administrative Code rules that make up the Top 10 deficiencies and violations
  • List at least three of the top ten deficiencies and violations cited in HCSSA agencies during the 2011 state fiscal year
  • Relate three areas where your agency may be able to improve processes to better protect clients' health and safety
  • Segment 3
  • Identify the key components of an agency’s emergency preparedness plan
  • List the phases of emergency preparedness planning and implementation
  • Recognize three questions a surveyor may ask on a survey concerning emergency preparedness
  • Segment 5
  • Identify at least 3 rule amendments adopted by DADS and approved by the DADS Council on March 8, 2012; and
  • Know what DADS form must be sent to DADS when there is a change in application information

About the Presenters: Yolanda Chavez, BSN, RN, is a HCSSA Policy Specialist for the Texas Department of Aging and Disability Services [DADS]. In this role Yolanda reviews, provides analysis of and response to state and federal regulatory inquiries.

Veronica Roberts, BSN, RN, is a Joint Training Specialist in the Home and Community Support Services program with Education Services for the Texas Department of Aging and Disability Services [DADS].
