Program Description: Each day seems to bring more news of enhanced enforcement by the various federal and state agencies. Most of the news revolves around the amount of penalties and damages being recovered from employers. Don’t let this be you.This program presents the hot buttons of liability that is causing employers problems over and over again. For example:

  • Which employees may be exempt under the Fair Labor Standards Act and how to pay them
  • Independent Contractor – fact or fiction
  • Compensable time quandaries such as
    • travel
    • on-call
    • waiting time
    • bonuses (discretionary and/or non-discretionary)

Of course we cannot leave out the companion exemption and the new expectations for home care employers. And everyone needs to know what the National Labor Relations Board says employees may post on Face book about employers and not be disciplined. Presentation Date: 11.19.2013

  • Provide a working knowledge of applicable employment laws in the Home Healthcare industry
  • Discuss current employment issues that affect the Home Healthcare industry
  • Review the most common legal employment problems and ways to address them

About the Presenter:
Daniel R. Stern, JD,
is board certified in labor and employment law by the Texas Board of Legal Specialization and represents company management in numerous labor and employment matters, including affirmative action plans; wage and hour issues; and discrimination and harassment claims. By recommending and developing effective employment policies and procedures, he helps clients reduce the risk of employment-related lawsuits.

Dan also works to bring existing policies into compliance with best practices in the human resource field and provides day-to-day counseling which enables clients to make wise decisions in human resource matters. Understanding the frequent and complex employment issues continually faced by today’s employers, Dan has designed his practice so that he is readily and quickly available to his clients. He is a frequent speaker and author on employment matters and labor-related legislative changes, with a particular focus on wage and hour issues.
